| SUN LAKES LIFESTYLES | JUNE 2024 | 15 Sun Lakes Committee Reports COMPLIANCE WITH RULES AND REGULATIONS WHEN MAKING IMPROVEMENTS TO YOUR HOME Sun Lakes Country Club HOA encompasses 1,000 acres and 3,327 residential units within its walls. CC&Rs and Rules and Regulations were established by the original developers to ensure an orderly and pleasant community, a high standard of living, and a means to protect, preserve, and enhance property values. (Article 1) The Master Architectural Committee (MAC) administers the Architectural Standards and Guidelines for the community. It is therefore necessary to obtain the MAC's approval for all exterior architectural improvements before any work commences. Any owner making unapproved external changes will be liable to the Association for the cost of removal and/or restoring unapproved changes to their original condition. (Article 1) Strict adherence to the Architectural Standards and Guidelines will ensure avoidance of potential problems and needless expense. Sun Lakes ensures compliance with exterior home improvement rules and regulations by the HOA's compliance inspection policy. 1. HOMEOWNER-REQUESTED INSPECTION Any homeowner may request a voluntary inspection at any time by submitting an inspection request form and payment of $50. A voluntary inspection will take place within 21 days. An expedited inspection can be requested for an additional fee. This inspection is very useful if a homeowner is anticipating buying or selling a home. This inspection gives the homeowner an opportunity to cure any violations before the sale of the property. 2. PRESALE INSPECTION Upon a request from an owner(s) or buyer(s) authorized escrow company, pursuant to CA civil code section 4525(a) (5) the Association shall schedule an inspection of the property within seven days. (Article V Sec. 5.05(2)) The inspector will note all apparent violations of the governing documents. If violations are found for unapproved improvements, the owner is required to secure approval through the approval of a home improvement application to the MAC. (Article V Sec. 5.05(4)(a)) If there is insufficient time for the violation to be cured before close of escrow, the owner must enter into an agreement with the buyer and the association to bring the property into compliance after the sale. (Article V, Sec. 5.05(4)(b)) Yes, okay, I'm almost done. Any owner who requests and receives an inspection report that indicates violations will be given a reasonable period to correct the violation before the Association commences enforcement action. 3. INVOLUNTARY INSPECTIONS The Association may also inspect the exterior of the homeowner's property at any time for compliance with the governing documents and may take such action as is appropriate if a violation is observed. (Article V Sec. 5.05(4)(c)) Planning and Compliance does routine exterior inspections of all properties and if a violation is noted the owner is notified to correct the violation. Failure to correct exterior violations can result in fines or a compliance assessment. (Article X Sec. 10.02) At present, Planning and Compliance is bringing up to date all the delinquent painting of the homeowner's exterior stucco and trim. This paint requirement was not enforced during Covid. Therefore some homeowners are three or more years behind in repainting their stucco or trim. To protect, preserve, and enhance our property value,s we all need to comply with the governing CC&Rs and Rules and Regulations of Sun Lakes Country Club. I encourage all homeowners to comply.
