On Feb. 19, the court approved our petition to clean up some super- majority voting requirements on some minor items that were not removed by our election. The CC&Rs were signed and notarized that afternoon, and they were recorded on Feb. 23 at 1:45 pm. Not that I was watching too closely. The Bylaws were signed and became effective the week of Feb. 29. They have already POSITIVELY IMPACTED our lives here in OHCC. On Feb. 1, we had our annual public budget review. For the first time in our 32-year HISTORY we included a Capital Improvement Fund and we now have a workable Capital Improvement mechanism. We are now funding Storage Solutions, and a Lanai replacement. I have lived here 11 years and we have been discussing both of those issues every year since then. We also have been working on our water intrusion problems, but we solved most of those with the Pool Deck/Palm Court/French Drain Project. Nothing is easy, and Murphy's Law is strong and well. We had many hurdles to overcome on restating our documents, including the last thing, the petition. For our Fri., Feb. 19 court date the judge sent out his tentative ruling on Wed., Feb. 17. That ruling was a DENIAL. We were shocked because his percentages didn't add up and his reasoning was confusing. During his explanation it became clear the judge misunderstood our voting results. He did not think we had achieved 67 percent of the votes cast. Laurie Poole, Senior Associate at Peters & Freedman, pointed out in our petition that the voting results clearly showed 80 percent on the CC&Rs and 81 percent on the Bylaws. He then approved it immediately. I started clapping and everyone joined in; the judge said it was his first ovation in court. This little OVERNIGHT SUCCESS took 2 ¾ years, or 33 months to bring to a completion. We started on June 17, 2013 and finished on Feb. 29, 2016. It was a tremendous amount of work but it was worth every minute of it! It is already helping us to manage our affairs more effectively. I now need to retire five three-ring binders full of 15 beautiful drafts, articles, flyers, letters, and memos. Shredding day is coming. CC&Rs Are Official, Include Capital Improvement Fund
